On May 26, 2009, USCIS updated the cournt of H1B petitions received and counted towards the H-1B cap on the USCIS website. As of May 22, 2009, approximately 45,700 H-1B cap-subject petitions had been received. Also, USCIS has received approximately 20,000 petitions qualifying for the advanced degree cap exemption. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

There is no doubt that over the past 10 years there has been so much abuse of the H-1B program that many Americans have been forced out of their jobs or had their salaries cut, thanks to the greedy Indian based Staffing and Outsourcing firms.
I've been in the business of providing IT professionals for almost 25 years. I believe that the H-1B program in theory is very good for America! The simple idea of the H1-B is to find the most talented and gift "minds" around the world and bring them into our economy. When we do this, these individuals become an important part of our economy, helping create new jobs. The problem we have had is that the Greedy Indian based staffing firms abused and violate the rules of the H1-B.
The abuses have gone so far out of whack, the H1-B is considered the cheap labor visa for the IT Industry. If these individuals are by far the best in world, then why are they being paid so little? If a great Pitcher from Cuba come to the US to play baseball, teams will be fighting to see who will pay this person the most. In mathematics, physics, engineering, and computer science the same applies. Anyone coming on the H1-B should be paid more than Americans, since they are so talented. The greedy IT Staffing firm from India have hijacked this program and destroyed it. To me it's a treasonous act against America to destroy or allow the this program to be abused.
Year after year it's the Indian Outsourcing and Staffing firms are the leaders in the number of H1-Bs issued, thus denying potentially great talent from coming into the USA. One company in 2006 applied for over 20,000 visas....and the funny thing is that we allowed it! Thanks to these Indian IT Staffing and Outsourcing firms, individuals who the H1-b is intended for, are blocked!! The talent that we are blocking today, maybe people, who in 10 years from now , are helping America with the next hot technology that will pump out economy....this is why I consider abusing the H1-b program as a treasonous act!
A lot more has to be done to bring this program back, so any little new requirements that would discourage the Indian Outsourcing cartel would be welcomed.
What I would like to see is that only those who possess Ph.Ds, Masters Degrees and/or hold various patents and copyrights should be allowed into the program. Also, we should put a quota on certain countries, like India, holding them to only 5000 visas. Trust me, the ones who deserve to come on H1-B from India would be in the wave of 5000 visa, if the Ph.Ds, Masters Degrees and/or hold various patents and copyrights requirements is applied.
